The Southwest Atlantic Ocean is characterized by a lack of jurisdiction that prevents coastal and concerned States from taking the necessary enforcement measures to ensure sustainable fisheries in areas beyond national jurisdiction. In this context, where Distant-Water Fishing (DWF) fleet activities pose an increased risk of Illegal, Unreported, and Unregulated (IUU) fishing—mainly supported by fisheries subsidies granted by flag States—this paper aims to analyze the implications of the absence of a regional mechanism to enforce international standards against IUU fishing in the Southwest Atlantic Ocean, and to explore possible actions that coastal States can undertake to promote fisheries enforcement across this critical area. The study demonstrates that the operations of DWF fleets have a significant impact on the livelihoods and security of coastal communities. Moreover, ongoing political disputes between Argentina and the United Kingdom regarding the Falkland/ Malvinas Islands have further hindered the enforcement of international fisheries regulations in áreas beyond national jurisdiction. In this context, the paper concludes that efforts to combat IUU fishing in the Southwest Atlantic Ocean are severely constrained by the lack of a regional enforcement framework. The recently adopted Agreement on Fisheries Subsidies is highlighted as a promising step toward addressing the regulatory void that currently prevents the effective implementation of widely accepted fisheries governance standards in the region.
El océano Atlántico sudoccidental se caracteriza por una falta de jurisdicción que impide a los Estados costeros y a los Estados interesados adoptar las medidas coercitivas necesarias para garantizar la sostenibilidad de la pesca en zonas que se encuentran fuera de la jurisdicción nacional. En este contexto, donde las actividades de la flota de pesca de altura (DWF) representan un mayor riesgo de pesca ilegal, no declarada y no reglamentada (INDNR) —principalmente respaldada por subsidios a la pesca otorgados por los Estados del pabellón— este documento tiene como objetivo analizar las implicaciones de la ausencia de un mecanismo regional para hacer cumplir las normas internacionales contra la pesca INDNR en el Océano Atlántico sudoccidental y explorar posibles accione que los Estados costeros pueden emprender para promover la aplicación de la normativa pesquera en esta zona crítica. El estudio demuestra que las operaciones de las flotas de pesca de arrastre tienen un impacto significativo en los medios de subsistencia y la seguridad de las comunidades costeras. Además, las disputas políticas entre Argentina y el Reino Unido sobre las Islas Malvinas han dificultado aún más la aplicación de las normas internacionales de pesca en zonas fuera de la jurisdicción nacional. En este contexto, el documento concluye que los esfuerzos para combatir la pesca INDNR (ilegal, no declarada y no reglamentada) en el Atlántico sudoccidental se ven seriamente limitados por la falta de un marco regional de aplicación de la ley. El Acuerdo sobre Subvenciones a la Pesca, recientemente adoptado, se destaca como un paso prometedor para abordar el vacío regulatorio que actualmente impide la aplicación efectiva de estándares de gobernanza pesquera ampliamente aceptados en la región.
O oceano Atlântico sudoeste é caracterizado por uma falta de jurisdição que impede os Estados costeiros e os Estados interessados de adotar as medidas coercitivas necessárias para garantir a sustentabilidade da pesca em zonas que se encontram fora da jurisdição nacional. Nesse contexto, em que as atividades da frota de pesca em alto-mar (DWF) representam um risco maior de pesca ilegal, não declarada e não regulamentada (INDNR) — principalmente apoiada por subsidios à pesca concedidos pelos Estados de bandeira — este artigo tem como objetivo analisar as implicações da ausência de um mecanismo regional para fazer cumprir as normas internacionais contra a pesca INDNR no oceano Atlântico sudoeste e explorar possíveis ações que os Estados costeiros podem adotar para promover a aplicação da regulamentação pesqueira nessa zona crítica. O estudo demonstra que as operações das frotas de pesca de arrasto têm um impacto significativo nos meios de subsistência e na segurança das comunidades costeiras. Além disso, as disputas políticas entre a Argentina e o Reino Unido sobre as Ilhas Malvinas dificultaram ainda mais a aplicação das normas internacionais de pesca em zonas fora da jurisdição nacional. Nesse contexto, o artigo conclui que os esforços para combater a pesca INDNR (ilegal, não declarada e não regulamentada) no Atlântico 117 sudoeste são seriamente limitados pela falta de um marco regional de aplicação da lei. O Acordo sobre Subsídios à Pesca, recentemente adotado, destaca-se como um passo promissor para enfrentar o vazio regulatório que atualmente impede a aplicação efetiva de padrões amplamente aceitos de governança pesqueira na região.

      1. < subfield label =" a " > The Southwest Atlantic Ocean is characterized by a lack of jurisdiction that prevents coastal and concerned States from taking the necessary enforcement measures to ensure sustainable fisheries in areas beyond national jurisdiction. In this context, where Distant-Water Fishing (DWF) fleet activities pose an increased risk of Illegal, Unreported, and Unregulated (IUU) fishing—mainly supported by fisheries subsidies granted by flag States—this paper aims to analyze the implications of the absence of a regional mechanism to enforce international standards against IUU fishing in the Southwest Atlantic Ocean, and to explore possible actions that coastal States can undertake to promote fisheries enforcement across this critical area. The study demonstrates that the operations of DWF fleets have a significant impact on the livelihoods and security of coastal communities. Moreover, ongoing political disputes between Argentina and the United Kingdom regarding the Falkland/ Malvinas Islands have further hindered the enforcement of international fisheries regulations in áreas beyond national jurisdiction. In this context, the paper concludes that efforts to combat IUU fishing in the Southwest Atlantic Ocean are severely constrained by the lack of a regional enforcement framework. The recently adopted Agreement on Fisheries Subsidies is highlighted as a promising step toward addressing the regulatory void that currently prevents the effective implementation of widely accepted fisheries governance standards in the region. </ subfield >

    19. < abstract > El océano Atlántico sudoccidental se caracteriza por una falta de jurisdicción que impide a los Estados costeros y a los Estados interesados adoptar las medidas coercitivas necesarias para garantizar la sostenibilidad de la pesca en zonas que se encuentran fuera de la jurisdicción nacional. En este contexto, donde las actividades de la flota de pesca de altura (DWF) representan un mayor riesgo de pesca ilegal, no declarada y no reglamentada (INDNR) —principalmente respaldada por subsidios a la pesca otorgados por los Estados del pabellón— este documento tiene como objetivo analizar las implicaciones de la ausencia de un mecanismo regional para hacer cumplir las normas internacionales contra la pesca INDNR en el Océano Atlántico sudoccidental y explorar posibles accione que los Estados costeros pueden emprender para promover la aplicación de la normativa pesquera en esta zona crítica. El estudio demuestra que las operaciones de las flotas de pesca de arrastre tienen un impacto significativo en los medios de subsistencia y la seguridad de las comunidades costeras. Además, las disputas políticas entre Argentina y el Reino Unido sobre las Islas Malvinas han dificultado aún más la aplicación de las normas internacionales de pesca en zonas fuera de la jurisdicción nacional. En este contexto, el documento concluye que los esfuerzos para combatir la pesca INDNR (ilegal, no declarada y no reglamentada) en el Atlántico sudoccidental se ven seriamente limitados por la falta de un marco regional de aplicación de la ley. El Acuerdo sobre Subvenciones a la Pesca, recientemente adoptado, se destaca como un paso prometedor para abordar el vacío regulatorio que actualmente impide la aplicación efectiva de estándares de gobernanza pesquera ampliamente aceptados en la región. </ abstract >
