Descripción:: The violence associated with the so-called War on drugs has caught the attention of the international community over the past few years. In September 2014, the International Federation of Human Rights submitted a request to the Prosecutor of the International Criminal Court to investigate, in a complementary way, the alleged commission of crimes against humanity in Mexico during the Felipe Calderon’s administration (2006-2012). Facing this scenario, this work studies the relevance of classifying the War on drugs such as internal armed conflict under the standards of international law. After that, it discusses the hypothetical application of the typology “crimes against humanity” to the previously indicated period. Finally, it details the major problems of using this figure in the Mexican case.; La violencia asociada a la Guerra contra el narcotráfico ha acaparado la atención de la comunidad internacional durante los últimos años. En septiembre de 2014, la Federación Internacional de Derechos Humanos presentó ante la Fiscalía de la Corte Penal Internacional una solicitud para investigar, de manera complementaria, la presunta comisión de crímenes contra la humanidad en México durante el mandato de Felipe Calderón (2006-2012). Ante ese escenario, este trabajo estudia la pertinencia de clasificar a la Guerra contra el narcotráfico como conflicto armado interno bajo los estándares de la legislación internacional. Luego, se analiza la hipotética aplicación del tipo penal “crímenes contra la humanidad” al periodo señalado previamente. Por último, se detallan los principales inconvenientes de utilizar esa figura en el caso mexicano..
